SO FRIENDS, BEWARE OF USING INDECENT AND OFFENSIVE LANGUAGE ON INTERNET.
- WHERE THE COMPLAINT IS MALAFIDE, VEXATIOUS AND FRIVOLOUS AND THE OPPOSITE PARTY HAS TO INCUR EXPENSES FOR CONTESTING THE COMPLAINT, THE COURTS SHOULD SADDLE THE LIAR COMPLAINANT WITH COST.SO BEWARE BEFORE FILING ANY FALSE COMPLAINT/ CASE.
- THE HIGH COURT HAS THE POWER TO QUASH THE FIR IN SECTION 482 OF THE CRIMINAL PROCEDURE CODE IN THE INTEREST OF JUSTICE. IT CAN QUASH THE FIR EVEN AT THE STAGE IT WAS LODGED WITH THE POLICE OFFICER, IF IT DOES NOT DISCLOSE ANY OFFENCE WHATSOEVER.
-THE FIR IS A DOCUMENT AND HAD TO BE PROVED LIKE ANY OTHER DOCUMENT BEFORE THE HON'BLE COURTS.
- RECORDING OF F.I.R. IS MUST:-
* It the information to an Officer-in-charge of a Police Station shows the commission of a Cognizable Offence, the Officer-in-charge is bound to register the F.I.R under Section 154 of The Criminal Procedure Code.
* It is not excuse to say that the information does not give sufficient detail or he cannot say that he would not write F.I.R. giving reason that the crime was not committed in his area.
- NOTHING IS AN OFFENCE, WHICH IS DONE BY PERSON IN THE EXERCISE OF THE RIGHT OF PRIVATE DEFENCE.
- THE COURT MINUTELY WATCHES THE SALIENT FEATURES AND THE CIRCUMSTANCES IN THE PROSECUTION ITSELF.
- IN JUDGING WHETHER THE PERSON HAS EXCEEDED HIS RIGHT TO PRIVATE DEFENCE OR NOT, THE COURT HAS TO TAKE INTO ACCOUNT THE WEAPONS USED.
- IN NORMAL CIRCUMSTANCES, POLICE OFFICERS ARE NOT PERMITTED TO ARREST WOMEN AFTER SUNSET AND BEFORE SUNRISE
- IF A POLICE OFFICER HAS TO ARREST WOMEN AFTER SUNSET AND BEFORE SUNRISE, THE WOMEN OFFICER SHALL OBTAIN THE PRIOR PERMISSION IN WRITING OF THE JUDICIAL MAGISTRATE OF THE FIRST CLASS BEFORE ARRESTING WOMEN.
- WHERE A WOMAN IS TO BE ARRESTED , UNLESS THE CIRCUMSTANCES OTHERWISE REQUIRE OR UNLESS THE POLICE OFFICER IS A FEMALE, THE POLICE OFFICER SHALL NOT TOUCH THE FEMALE FOR MAKING HER ARREST .
- IN EXERCISE OF POWERS OF THE COURT, THE COURT CAN GRANT POLICE AID TO ENSURE EFFECTIVE IMPLEMENTATION OF ORDERS OF THE COURT AND ALSO FOR THE SECURITY OF THE WITNESS OF THE CASE.
- WOMEN WHO, ACCORDING TO THE CUSTOMS AND MANNERS OF THE COUNTRY, OUGHT NOT TO BE COMPELLED TO APPEAR IN PUBLIC SHALL BE EXEMPT FROM PERSONAL APPEARANCE IN THE COURT.
- IT IS A SETTLED LAW THAT IN CASE ANY MARRIED LADY LEAVES HER HUSBAND WITH HER OWN WILL AND REFUSES TO LIVE WITH HER HUSBAND IN FUTURE, THEN SHE IS NOT ENTITLED FOR ANY KIND OF MAINTENANCE FROM HER HUSBAND.
- IT IS A SETTLED LAW THAT THE PERSON WHO TRIES TO MISGUIDE AND MISLEAD THE HON'BLE COURT BY GIVING FALSE STATEMENTS IN HER/HIS CASE, FILED BEFORE THE HON'BLE COURT THEN HE/SHE WOULD NOT GET ANY KIND OF RELIEF FROM THE COURTS.
