कोविड-19 के चलते पूरे देश की जिले की निचली अदालतें 21 मार्च के बाद से ही बन्द चल रही है, क्योंकि कोर्ट कैंपस में Social distancing का पालन करना मुमकिन नही हो पाता इस कारण जहां एक तरफ पूरा देश अनलॉक-1 से धीरे-धीरे खुलने लगा है । बाजार का मॉल भी alternate day के हिसाब से खुलने लगे है, सरकारी, अर्धसरकारी तथा निजी कार्यालय भी सुरक्षा मानकों के साथ खुलने लगे है, परन्तु जिलों की अदालते अभी भी बंद चल रही है।
निचली अदालतों में एडवोकेट्स का बहुत बड़ा वर्ग है जो साधारण प्रष्ठभूमि वाले परिवारों से आता है, एक समय हुआ करता था जब वकालत आय से ज़्यादा मान-सम्मान का पेशा हुआ करता था, परन्तु आज स्थितियां बदल गयी है, आजकल हर आय वर्ग के परिवारों से एडवोकेट्स वकालत करने आ रहे है। बढ़ती बेरोजगारी के चलते कोर्ट कैंपस बेरोजगार नवयुवकों का डंपिंग ग्राउंड बनते जा रहे है, ऐसी स्थिति में आज किसान का बेटा, मजदूर का बेटा, रिक्शे वाले का बेटा, सब्जी वाले का बेटा तथा मध्यम एवं लोअर मध्यम वर्ग के परिवारों से भी नवजवान आकर वकालत कर रहे हैं।
कोविड-19 के चलते जबसे पूरा देश लॉक-डाउन हुआ तबसे लगातार निचली अदालते बन्द चल रही है। लगातार निचली अदालतों के बन्द रहने से ऐसे परिवारों से आने वाले एडवोकेट्स की आर्थिक स्थिति दयनीय होती जा जा रही है, चूंकि एडवोकेट्स के पास आय का कोई दूसरा जरिया नही होता इसलिए एक बड़ा तबका है ज़िले की कचहरियों में जिसके सामने रोजी रोटी का संकट पैदा हो गया है। इन स्थितियों के बावजूद भी एडवोकेट्स समुदाय की आर्थिक मदद के लिये न तो किसी भी प्रदेश सरकार द्वारा और न ही केंद्र सरकार द्वारा कोई भी पहल नही की गई। यहां तक कि प्रदेश की बार कौंसिल और बार कौंसिल ऑफ इण्डिया के द्वारा भी इस दिशा में कोई सार्थक प्रयास नही किया गया।
ज़िले के स्तर पर स्थानीय बार एसोसिएशनस ने अवश्य अपने स्त्रप पर कुछ एडवोकेट्स को आर्थिक मदद दी है, परन्तु वह नाकाफ़ी है, आपको यह भी बताता चलूं कि कोर्ट कैंपस के अंदर एडवोकेट्स को छोड़कर टाइपिस्ट, मुंशी तथा वेंडर्स की भी एक अच्छी खासी तादात होती है। कोर्ट बन्द होने के कारण इन लोंगो का भी आय का कोई भी साधन नही रहा, जिस कारण इन लोंगो के समक्ष भी रोजी-रोटी का संकट पैदा हो गया है, दुःख व हैरानी की बात ये है कि इन लोंगो के बारे भी किसी भी सरकार के द्वारा नही सोंचा गया।
अभी हाल ही में बार कौंसिल ऑफ इण्डिया के द्वारा प्रधानमंत्री श्री नरेन्द्र मोदी जी को अपना वह वादा याद दिलाया गया जो उन्होंने BCI के कार्यक्रम में किया था, और अधिवक्ताओं के कल्याण से सम्बंधित 10 सूत्रीय मांगपत्र का ज्ञापन दिया है।
बार कौंसिल ऑफ इण्डिया के द्वारा प्रधानमंत्री मोदी जी अधिवक्ताओं के कल्याण हेतु की गई मांगे:-
1. Insurance cover up to Rs. 20, 00, 000/- for the Lawyers and their families (dependents).
2. Medi-claim: free medical treatment of every type of disease in best Hospitals of India & other countries (if needed) for the Advocates. Lawyers should be provided a “special card” for this purpose, so that they could avail the benefit of this schemes anytime, anywhere.
3. Stipend for needy new entrants at the Bar upto 5 years of their practice (Minimum Rs. 10, 000/- Per Month).
4. Scheme for pension for old/indigent Advocates and provision for family pension in case of untimely death of Advocates (Minimum Rs. 50, 000/- per month).
5. Advocates Protection Act to be enacted for Advocates of the Country by the Parliament.
6. All the Bar Associations of the country should have adequate building/accommodation/sitting facilities with well-equipped Libraries, e-libraries, with internet, toilets etc. and facilities for lady advocates.
7. Interest-free house loans, loans for Library, Vehicle for the needy Advocates. The government should acquire lands at cheaper rates for the Housing of Advocates.
8. Legal Services Authority Act – Amendments & necessary changes should be made in the Act so that the functions under this Act could be discharged by the Lawyers (and not the Judges or Judicial Officers only.
9. All the Acts (which provide for appointments of retired Judges/Judicial Officers as the Presiding Officers/ Member of different Tribunals, Commissions of Forums/ Authorities) should be properly amended so that competent Advocates (and not only the Judges) could also be appointed on these places.
10. In case of untimely death of any Advocate (below 65 years of age) due to accident, murder, any disease, the Government should grant the family/dependents at least a sum of Rs 50, 00, 000 /- (fifty lakhs).
बार कौंसिल ऑफ इण्डिया ने मोदी जी से मांगपत्र के जरिये यह मांग की है उक्त मांगों को पूरा करने के लिये केंद्रीय बजट में 50,000/- करोड़ रुपये की धनराशि को आवंटित करने की मांग की।
